On June 4, 2010, the Tennessee legislature passed Senate Bill Number 3591 of Public Chapter Number 1149.? Former Governor Phil Bredesen approved the enactment on June 30, 2010, and a number of provisions contained in the bill officially took effect on March 1, 2011.? A large portion of this bill created a new subsection of Chapter 6 of Title 50 of the Tennessee Code Annotated and this new portion is codified at Tennessee Code Annotated ? 50-6-901, et. seq.? Of note, this new section now requires all construction services providers to carry workers? compensation insurance on themselves.? See T.C.A. ? 50-6-902(a)(emphasis added).? ?Construction services provider? means ?any person or entity engaged in the construction industry.?? See T.C.A. ? 50-6-901(5).? This requirement set out in subsection (a) applies regardless of whether the provider employs fewer than five employees.? See T.C.A. ? 50-6-902(a).

Construction services providers may apply for an exemption from section 50-6-902(a) if they meet one of the following criteria: [1] if the individual is an officer of a corporation who is engaged in the construction industry, but no more than three officers of one corporation are eligible for an exemption; [2] if the individual is a member of a limited liability company who is engaged in the construction industry if such member owns at least thirty percent of such company; [3] if the individual is a partner in a limited partnership, limited liability partnership or a general partnership who is engaged in the construction industry if such partner owns at least thirty percent of such partnership; [4] if the individual is a sole proprietor engaged in the construction industry; or [5] the individual is an owner of any business entity listed in the first three examples in this paragraph, but no more than three owners of one family-owned business may be exempt.? See T.C.A. ? 50-6-903(a).? It is important to note that, if a construction services provider is exempt from Section 50-6-902 based upon one the criteria above, then no construction services provider of an affiliate of such an exempted provider is eligible to apply for or receive the same exemption.? See T.C.A. ? 50-6-903(b)(1).? Section 50-6-904 of this new Code section provides the method of applying for an exemption with the state and describes the exact information needed to make such application.? See T.C.A. ? 50-6-904.?

To the extent there is no restriction on applying for an exemption pursuant to Section 50-6-903, a construction services provider is exempt from Section 50-6-902(a) if the provider: [1] is a construction services provider rendering services on a project that is not a commercial construction project and is listed on the registry; [2] is a construction services provider rendering services on a commercial construction project, is listed on the registry and is performing a project where no more than three construction services providers are performing direct labor on a commercial construction project; [3] is covered under a policy of workers? compensation insurance maintained by the person or entity for whom the provider is providing the services; [4] is a sole proprietor or partner engaged in the construction industry doing work directly for the owner of the property; [5] is a sole proprietor or partner building a dwelling or other structure, or performing maintenance, on the sole proprietor or partner?s own property for the sole proprietor or partner?s use and for which the sole proprietor or partner receives no compensation; or [6] is a provider whose employment at the time of injury is ?casual? within the meaning of T.C.A. ? 50-6-106.? See T.C.A. ? 50-6-902(b).?

A subcontractor working in the construction industry under contract to a general contractor engaged in the construction industry may elect to be covered under any policy of workers? compensation insurance that insures the general contractor upon written agreement of the general contractor, regardless of whether such subcontractor is on the registry established under this new section of the Code, by filing written notice of the election, on a form prescribed by the Commissioner of Labor and Workforce Development, with the department.? See T.C.A. ? 50-6-902(c).? It is the responsibility of the general contractor to file the written notice with the department.? It is also important to note that the failure of the general contractor to file the written notice does not operate to relieve or alter the obligation of an insurance company to provide coverage to a subcontractor when the subcontractor can produce evidence of payment of premiums to the insurance company for the coverage.? See T.C.A. ? 50-6-902(c).? Under this new section of the statute, this election does not terminate or affect the independent contractor status of the subcontractor in any way for any other purpose than to permit workers? compensation insurance coverage.? The election of coverage may be terminated by the subcontractor or general contractor by providing written notice of the termination to the department and to all other parties consenting to the prior election.? The termination is effective thirty days from the date of the notice to all other parties consenting to the prior election and to the department.?

Any action to recover damages for an injury, as defined by Section 50-6-102 of the Tennessee Workers? Compensation Law, by a construction services provider who was on the registry at the time of such injury, who was not covered under a policy of workers? compensation insurance maintained by the person or entity for whom the provider was providing services at the time of the injury, is to proceed as at common law, and the defendant in the suit may make use of all common law defenses.? The construction services provider must forego the right to sue or reestablish workers? compensation coverage for any injuries that occurred while the construction services provider was listed on the registry.?

Under this new Code section, a general contractor, intermediate contractor or subcontractor is liable for compensation to any employee injured while in the employ of any of the subcontractors of the general contractor, intermediate contractor or subcontractor and engaged in the subject matter of the contract to the same extent as the immediate employer.? T.C.A. ? 50-6-914(a).? It is important to also note that Section 50-6-914(b) provides that a general contractor, intermediate contractor or subcontractor is not liable for workers? compensation to a construction services provider listed on the registry established by this new Code Section.? It is the responsibility of the general contractor to provide notice to any construction services provider who provides services to the general contractor and who is listed on the registry that such provider is not eligible for an exemption pursuant to this new section.? See T.C.A. ? 50-6-914(b)(2)(C).? Any contractor who pays compensation under T.C.A. ? 50-6-914(a) may recover the amount paid from any person or entity who, independently of this new Code section, would have liable to pay compensation to the injured employee, or from any subcontractor.? T.C.A. ? 50-6-914(c).?

Every claim for compensation under this section shall be presented first to and instituted against the immediate employer, but the proceedings do not constitute a waiver of the employee?s rights to recover compensation under this chapter from the general contractor, immediate contractor or subcontractor; provided, that the collection of full compensation from one employer bars recovery by the employee against any others, and the employee shall not collect from all employers a total compensation in excess of the amount for which any of the contractors is liable.? T.C.A. ? 50-6-914(d).? It is lastly important to note that this new section applies only in cases where the injury occurred on, in, or about the premises on which the general contractor has undertaken to execute work or that are otherwise under the general contractor?s control or management.? T.C.A. ? 50-6-914(e).?

Flooding In Louisiana's Great Basin: A Good Thing?

The Army Corps of Engineers opened another bay on the Morganza Spillway Wednesday ? diverting more water off the Mississippi through the bayous and rivers of Louisiana's Atchafalaya Basin.

The corps says it will divert as much water as necessary to keep the Mississippi no higher than 45 feet as it passes through Baton Rouge.

But some of that water might actually be welcome.

'We Need Good Water'

Few people pay closer attention to water conditions in the Atchafalaya Basin than those who make their living catching crawfish.

Lee Wisdom and other craw fishermen in St. Martin Parish are launching their boats, not off the ramps, but from the levee. They can't get to the ramps. Water has already risen several feet on Bayou Benoit. And water from the Morganza Spillway hasn't even reached this area yet.

Mike Bienvenu, head of the Louisiana Crawfish Producers Association, says he's not sure whether the coming flood will improve the crawfish crop or not.

"We don't like high water. High water is not good. We need good water. All we need is three or four feet [of] water to crawfish in, that's all we need," he says.

Craw fishing has declined here in recent years. Bienvenu and others blame the web of canals and levees that oil and gas companies have put in the Atchafalaya Basin, keeping fresh water from some bayous.

When the high water hits this area in coming weeks, it will flush out stagnant ponds with fresh water full of oxygen and sediment. Harold Schoeffler, who has fished these waters his whole life, says that's bound to improve things in the basin.

As water washes up on levees and other formerly dry areas, he says long-dormant crawfish will come out of the mud and start breeding.

"So you get this phenomenal production," Schoeffler says. "And then shrimp. This is an estuary where shrimp from the Gulf come into this system and reproduce. So you have this phenomenal amount of nutrients and water that's going to cause an enormous growth of shrimp that feeds speckled trout and redfish and flounder. And the whole thing just takes off."

Short term, the high water is threatening a huge animal population including as many as 150 black bears, plus many deer and smaller mammals. Schoeffler, who is the longtime chairman of the Sierra Club in this part of Louisiana, says, for the most part, the animals should do fine. Water is rising slowly, and he says, even at the crest, there will be plenty of high ground in the basin.

"We have spoil banks up there 50, 55 feet above sea level," he says. "Many hills in the 35- to 45-foot range, which are really an island for wildlife."

A Natural Part Of The Basin Ecology

It might be surprising that, although 1.5 million cubic feet of water per second may soon be released into this basin, those living here are remarkably undisturbed. That's in part because flooding is a natural part of this area's ecology.

This flood event, the largest since 1973, will reshape the basin ? filling in some swamps with sediment and turning them into hardwood forests.

For Louisiana's long-eroding coastal wetlands, though, this flooding is a good thing.

Ivor van Heerden, a marine scientist formerly with Louisiana State University, says the tons of sediment washing down the river will spur plant and animal life and help build new wetlands.

"In the central part of the coast, because of the Atchafalaya, we're going to definitely be creating new marshes. We're going to be rejuvenating a huge area of marsh, so a lot of benefits," he says.

Paul Kemp of the National Audubon Society agrees. Unfortunately, he says, the place where new sediment and new marshes are needed most desperately ? below New Orleans at the mouth of the Mississippi ? won't be helped by the flood. Because of efforts to keep the Mississippi wide open for navigation, any sediment flowing down the river is likely to be dredged and dumped, not in coastal areas, but off the Continental Shelf.

"And I would have loved to say, 'This was the event we were waiting for. We were prepared and we were able to do 50 years of restoration in one year.' I can't say that today," Kemp says.

Kemp, van Heerden and others active in coastal restoration, hope this event will persuade the Army Corps of Engineers and other public agencies to take steps allowing not just the Atchafalaya but also the Mississippi to actually benefit from the flood.

Does Self Help Do You Any Good? | My Blog

I recently read an article on the BBC?s International News website ? Self Help Makes You Feel Worse. The article cited new Canadian university research and stated that people with ?low self-esteem actually felt worse? as a result of what the article?s author obviously considered to be practicing self-help. The article went on to explain that the University of New Brunswick and the University of Waterloo had measured research participants? moods after they had repeated ?I am a lovable person?. The researchers? conclusion was that ?self-help? only works for people with high self-esteem and, in fact, makes people with low self-esteem feel worse.

The problem is that repeating ?I am a lovable person? to yourself ? when the facts of your daily life suggest otherwise ? is not self-help, it?s self-delusion. It?s just like the magical illusion where the magician saws his beautiful assistant in two ? we all see it happen but we know in our heart and soul that the theatre isn?t littered with bloodied body parts!! The researchers in question appear to me to have been a little naive.

If you don?t believe your own self-worth in your heart and soul, no amount of trite self-affirmation will fix you up. Of course you?ll feel worse for the experience because you?d tried to convince yourself that you were a ?lovable person? (or whatever other nonsense you might repeat to yourself) and not only have you proved that such nonsense doesn?t work ? you?ve proved yourself right, all over again, that you?re not, in fact, a ?lovable person?!

So, self-affirmation is next to useless ? but it?s got very little to do with true self-help that can, to quote from Nelson Mandela, ?liberate us from our own fears? and enable us ?shine our light? for all the world to see. First things first ? as I?ve just said, self-affirmation is just smoke and mirrors that make no difference to the quality of your life, your self-image, your success or happiness. Why? Because self-affirmation is addressed to the conscious mind ? the part of our mind where we do our thinking. But it?s our subconscious mind where we do our doing. Seventy years research proves conclusively that your subconscious mind creates your behaviour and reactions and, as a result, creates your life and who you think you are. It?s in your subconscious mind that you hold your beliefs ? in your heart and soul, so to speak.

So, if you don?t believe, in your heart and soul, that you?re a ?lovable person?, no amount of self-talk will convince you otherwise. You need to get to the very heart of the matter ? in your subconscious mind. Before we explore how to do that, it?s important to understand that your current limiting self beliefs are there because, as young and impressionable children, things were impressed on our subconscious mind. If something happened us in our formative years that made us feel uncomfortable or inadequate, our subconscious mind?s replaying of that event continues to make us feel that same way many years later.

You need to by-pass your subconscious mind?s proven obsession with the past. And, when you stop to think about it, the solution to your perceived problems is absolutely and obviously found in the present. You simply need to re-learn how to focus in the here and now. I say ?re-train? because, as children, we were all expert at paying attention to the present moment ? we didn?t worry about next month?s mortgage, whether we?d get that promotion or why our neighbour had a bigger car than ours ? we simply went about our business in the here and now.

If you want to improve your life, your ?self-esteem?, your happiness, your success, you need to become like a child all over again ? childlike, not childish. You need to train your subconscious mind to focus in the present moment ? the more you do this, the less your subconscious mind can focus in the past. Your past ?programs? won?t go away but as you give them less and less energy, they will hold less and less power over you and your life will begin to change.

You retrain your mind to focus in the present by using your five senses ? by training yourself to pay detailed attention to what you see, feel, hear, smell and taste only in the present moment. For starters, this should be done in the privacy of your own home ? otherwise normal people will think you?re mad (by the way, all the evidence points to the fact that it?s the normal people who are, in fact, mad). Or you could deliberately choose to go for a stroll to practice using your five senses. If you like working out or jogging, you could use these activities as an opportunity to pay full attention to what you?re feeling in your body, in the muscles and muscle groups that you?re using ? it means you?ll have to unplug the iPod!!

Little by little, day by day, we can all recreate our lives through bringing our attention into the only place and time that we have ? the here and now. Little by little we will realise low self-esteem for what it is ? another illusion, this time created by subconscious snapshots we took of events long gone. Little by little anybody ? and that includes you ? can create the life, happiness, success, relationships that your heart desires. But it?s something that?s done little by little ? every day ? and the little by little will give rise to startling results.

If this is true, the president of the United States will be asking an ally -- though he probably bristles at such a narrow-minded concept -- to accept a Judenfrei West Bank, washed of all aggressive settlers, prosperity and progress. The president, if the report is true, will be asking the Jews to surrender the old city of Jerusalem and place it under new management. Hamas-Fatah management.

Why, one wonders, wouldn't Israelis jump all over such a fabulous offer?

It's not that Hamas is a belligerent terrorist organization that won't accept the existence of Israel -- the Jews are blessed with similar neighbors in Syria, Hezbollahstan and soon-to-be Muslim Brotherhood Land. It's that no treaty with Hamas is worth the parchment paper it's scribbled on. Obama would never send a treaty with Hamas to the Senate, so why would we expect Israel to enter into one?

The Arabs, though, will also demand the 'right of return' for refugees. In truth, whether the Israeli government leans left or right, the probability of any return of "refugees" is as remote as the chance of my "returning" to a ghetto in autonomous Transylvania.

History moves on. The Arab world refuses. On al-Nakba day (belated greetings!) last week -- a day on which Arabs mourn not the loss of West Bank or Gaza but the existence of a Jewish state in any configuration -- the Syrian regime encouraged a few thousand Palestinian "refugees" to bum rush the border to deflect attention away from the ongoing brutalization of its own people. What's another 12 lives?

CANNES -- Bollywood: The Greatest Love Story Ever Told is very much a mixed blessing.
