Ensure business need for literacy requirement ? Business ...

Do you require basic literacy for every job? If so, the EEOC may soon be knocking on your door.

The agency has just won the right to rifle through an employer?s files for job descriptions to justify a broad literacy requirement.

Recent case: Kevin was born in Jamaica and can neither read nor write English. He worked temporary assignments as a laborer for Rand??stad, a large national temp-services company. When he arrived at his third job, the client company asked him to fill out forms.

That?s when he called Randstad for help and was informed for the first time that literacy was a basic requirement for any assignment.

Kevin filed an EEOC complaint, alleging race discrimination. Later, he added disability discrimination after tests revealed learning disabilities that prevented him from reading or writing.

The EEOC took up the cause, subpoenaing Randstad and demanding job descriptions and employee rec??ords that might show whether reading and writing really was a minimum requirement for every position the company filled for client companies.

Randstad refused to comply and took the question to federal court. The trial judge refused to enforce the subpoenas, but the EEOC appealed.

Now the 4th Circuit Court of Appeals has reinstated the subpoenas, ordering the company to comply?despite an estimated cost of $19,000. (EEOC v. Rands??tad, No. 11-1759, 4th Cir., 2012)

Final note: Ensure there?s a good, business-related reason for any literacy requirement. That?s especially true of lower-level jobs such as cleaning, stocking and other unskilled positions. If literacy isn?t essential, don?t require it.

And remember that if an applicant can?t complete application forms, he or she may be disabled and entitled to reasonable accommodations such as assistance filling out the paperwork.

Shatoetry iPhone app lets you put words in William Shatner's mouth

William Shatner and technology go way back, but it's taken him until today to get his own smartphone app. Then again, he is a man known to take long pauses. Dubbed Shatoetry, the new app (iPhone-only, for the moment) lets you string together a variety of pre-recorded words -- each with three different versions -- and have the resulting "Shatism" read aloud by Shatner himself. You're then able to send the message to your friends through all the usual means, or even take advantage of a co-op mode that lets you collaborate on a phrase. Of course, spoken word Shatner on-demand doesn't come free -- the app will set you back $2.99.

Report: Microsoft may make its own Windows Phone hardware

Microsoft is working with Asian suppliers to create its?own Windows Phone hardware, says the Wall Street Journal.?

You could be forgiven for asking, "Didn't Microsoft just launch its own phones?" But those new Windows Phone 8 models run software from Microsoft on hardware built by Nokia and HTC, while the rumored phone in question would be Microsoft through and through.

Controlling both hardware and software is the model long held by Apple, adopted by Google as well in recent years. (At least in part: Google still licenses its Android operating system to companies like Samsung, and its flagship Nexus phone is built by LG; its own hardware company, Motorola, has yet to graduate to home team status.) By producing all parts of the mobile device, including online services, it is possible to provide a more integrated, predictable experience for the user.

This isn't the first time we've heard reports of?Microsoft's purported moves into phone hardware. And any forays into first-party hardware may simply be a backup plan in case Windows Phone 8 fails to gain traction with customers on other partner devices.

But as the recent launch of the Microsoft Surface proves, Microsoft is willing to take steps into hardware manufacturing that seemed alien to the company as recently as a year ago.?

Eastern European Universities ? the new top destination for international students
As our world embraces change, many international students are now choosing to study at Eastern European universities. Universities from Ukraine, Russian, Estonia, Hungary, Poland and the Czech Republic regularly make an appearance in the QS World University Rankings and with excellent teaching staff and modern facilities, it?s hardly surprising that many of our young academics are choosing to continue their education in former communist countries.
Certainly the Russian Universities consistently warrant a mention, with 10 of their institutions appearing in the top 600 in the world, a testament to the nation?s growing academic strength, achieved by an investment of over US$4.1 billion by the Russian Government between 2011 and 2015. The Russian education system has long been known as a provider of quality education and continues to improve and introduce new and innovative ways to make the application process easier for international students.
Recently, the Ministry of Education and Science have started to offer public Bachelor, Specialist and Postgraduate scholarships for foreign citizens and Russians living abroad to study at federal state higher professional education institutions. Furthermore they announced a list of 210 foreign universities from 25 countries, whose students will be eligible to apply at Russian Universities with ease. As a result of this many international students are opting to head to Moscow to take in not only the culture of this thriving metropolis but to emerge themselves into academia Russian style and to take advantage of growing business opportunities once qualified. It?s a particularly attractive destination for graduate students and many universities are now offering courses in English to facilitate overseas students.
International students coming different parts of the world, especially from West Africa including countries like Nigeria, Ghana and other parts such as south Africa are now choosing to eastern countries for university education choosing to Study in Ukraine, and Poland.
Perhaps the most widely recognised and renowned Eastern European University is the Lomonosov Moscow State University which is ranked 112 in the world according to the QS World University Rankings. Its success is largely attributed to its exceptional faculty/student ratio. In fact, based on this factor alone, the university is placed 7th in the world. Established in 1755, it?s now home to over 40,000 graduate and post graduate students and a further 7000 undergraduates. With 6000 professors and lecturers, this is a university of magnitude! Every year approximately 4000 international students and post grads from all around the world enrol on their courses. As you can imagine to house this amount of students, the complex is huge, with over 1000 buildings and structures. The library alone holds over 9,000,000 books; 2,000,000 of which are in a foreign language. All courses at the Lomonosov are delivered in Russian, although there is the opportunity to take a preparatory course in Russian before commencing your degree.
Also in the capital is the Bauman Moscow State Technical University. Ranked at 379 in the 2011 QS World University Rankings, this is an Engineering University of educational excellence. Founded in 1830 as an Emperor?s Vocational School, it?s now home to a faculty of 3500, 18,000 students and 1000 post graduates. Since 1991, when it first opened its doors to international students, the numbers have grown from 3 to 300, with students from more than 20 different countries. Students need to proficient in the Russian language as most courses are delivered in Russian, although some are taught in English and French.
St. Petersburg State University currently ranks at 276 and, as the oldest institution of Higher Education in Russia, attracts over 32,000 students throughout 20 faculties with a staff of over 14,000 including 6,000 teachers. In November 2009, Russian President Dmitry Medvedev assigned a law granting St. Petersburg the status of ?a unique scientific and educational complex, an oldest institution of Higher Education in Russia being of great importance to the development of Russian Society?. As a major centre of science, education and culture it has links with many renowned Universities around the world, including Cambridge, Bologna, the Free University of Berlin, Hamburg and Amsterdam. Most degree programmes are open to foreign applicants, with some courses being taught in English, although, of course, the majority of programmes are delivered in Russian.
Although Russia is doing an excellent job in attracting overseas students, many international students do opt to study in other countries in Eastern Europe.
The Central European University in Hungary, (currently ranked at 372) is a relative newcomer in the educational sector, being only 20 years old. It was founded by George Soros, one of the world?s richest men and is a mainly graduate focused institution with a mere 1500 students. An extremely wealthy financier, Soros is one of the original founders and the chief benefactor of this Graduate Institution which welcomes international students from over 100 countries into its Faculties each year. Concentrating on Social Sciences, Humanities, Law and Management, the university is accredited in both the United States and Hungary and offers English Language Masters and Doctoral programmes. It?s an extremely popular choice for foreign students as the main language used throughout the university, both for teaching and for socialising is English.
Founded in 1348 by King Charles IV, the Charles University in Prague is the oldest and largest university in the Czech Republic. It?s one of the oldest and most successful universities in Europe and ranks amongst the top 1.5% in the World, (2011 ranking of 276). When first formed, there were four main faculties of Theology, Arts, Law and Medicine although this has grown to 17, mainly concentrating on Theology and Medicine, with the additions of Pharmacy, Social Sciences, Physical Education and Sport. As one of the oldest European Universities it?s certainly had an interesting history and can count Albert Einstein as a former almuni. In 1939 it, along with all other Czech universities, was closed for 3 years, although this closure extended throughout the period of the Second World War until 1945. Today it enjoys a reputation of being one of the finest universities in Eastern Europe, with almost 53,000 students and approximately 8,000 staff, of which 4,400 are academic and research staff. The 300 accredited degree programmes attract over 9,000 international students each year.
So as you can see, Eastern European Universities offer an excellent alternative for study and are fast becoming the new top destination for international students, especially for those who wish to experience a different culture as they gain their qualifications. (AP) ? Bill Mott is in position to duplicate the ultimate daily double. The Hall of Fame trainer swept the $2 million Ladies' Classic and $5 million Classic at last year's Breeders' Cup. He could do it again this weekend, with Royal Delta defending her Ladies' title and three of his horses running in the big race.

The Breeders' Cup has been dominated by females in recent years, led by Zenyatta, Rachel Alexandra and Havre de Grace, whose body of work garnered Horse of the Year honors for each of them.

It could happen again starting Friday, when Royal Delta heads one of the deepest fields ever in the Ladies' Classic at Santa Anita. She's the 9-5 favorite for the 1 1/8-mile race. She could help Mott make history, too, as the first trainer to win the race three straight years and fifth time overall.

But two undefeated fillies are in her way.

Awesome Feather is 10-0, while My Miss Aurelia is 6-0. Both won the BC Juvenile Fillies as 2-year-olds.

Mott comes back strong on Saturday with Flat Out, Ron the Greek and To Honor and Serve in the Classic. The 9-5 early favorite for the 1 ?-mile race is Game On Dude, trained by Hall of Famer Bob Baffert and co-owned by Joe Torre, former manager of the Los Angeles Dodgers and New York Yankees.

"It's pretty unusual to have three horses of that quality in that type of race," Mott said. "If you really asked me who I would pick, one over the other, I couldn't do it. That's how well they're doing."

Game On Dude led most of the way in last year's Classic at Churchill Downs before Drosselmeyer overhauled him in the closing strides to win for Mott, who could become the second trainer since Jay Robbins in 2000-2001 to repeat in North America's richest race.

John Shirreffs completed the BC double in 2009 with Life is Sweet in the Ladies' Classic and Zenyatta in the Classic.

"I'm not trying to do it just because we did it last year," Mott said about his attempted double. "I feel no pressure to do that. I just want to do it because we're in there. I've got three good horses in the Classic and I think any one of them could win the race on their big day."

Mott had bid Royal Delta farewell a week after her victory at Churchill Downs last November. Her breeder-owner Prince Saud bin Khaled had died earlier in the year and his racing stable was sold to settle his estate. Royal Delta was sold to Benjiman Leon for $8.5 million.

"I had no expectations of getting her back," Mott said. "It was a sad day when I had to walk her out of my barn down to that van and send her to Keeneland. It was a little bit like I was walking to my best friend's funeral."

Mott attended the Keeneland sale and congratulated Leon after his purchase. The new owner told Mott to call him in a week or two, and that's when he found Royal Delta was coming back to his barn.

"It was great," the trainer said.

Of Mott's three Classic horses, both Flat Out and Ron the Greek came to him from other stables, while To Honor and Serve has been with him from the start.

Flat Out finished fifth, beaten three lengths, in last year's Classic for trainer Scooter Dickey. His owner wanted the horse in New York, where Mott is based, and he got him. Flat Out has tender feet, making him a challenge to train.

"He's been a willing student and done everything we've asked of him," Mott said, noting the horse won the Jockey Club Gold Cup the last two years.

Ron the Greek was transferred to Mott in mid-2011 and has blossomed into a four-time stakes winner. To Honor and Serve has eight wins in 16 career starts.

But before you start readying your zombie apocalypse weapon of choice, you?d better find out if you?re going to get in trouble for taking out the infected. According to San Diego criminal lawyer Peter M. Liss, zombie killing won?t result in murder charges; after all, while zombies were once people, they aren?t technically living anymore. There are other issues you need to consider, though:

In California, it is illegal to desecrate a corpse. Again, a defense lawyer would most likely be able to fight the charges if you were acting in self defense, but if you killed the zombies when you were not in danger, you could be subject to charges. Additionally, if you used firearms to murder the walking dead, you could be arrested and charged with firing a weapon within city limits, carrying a concealed weapon and illegal possession of a firearm if you did not obtain the weapon through proper legal channels.

Most states have laws against the desecration of a corpse and firearms laws similar to those in California. Of course, if things have already reached zombie apocalypse levels of madness, you probably won?t need to worry about getting busted?any cops left will be pretty concerned with killing the undead, and governments will most likely have fallen apart, so there would be no one to try you for your crimes. So go ahead, take that headshot!
